The Power of Pre-Nups: Choice of Law

Now that it's cuffing season, it's a perfect time for the newly engaged to consider a premarital agreement. Pre-nuptial agreements let you plan ahead for all of life’s changes.

Recently I worked with a military couple, Zeke* and Jess*. They are both from Indiana and are both in the army. They don't know where they might be living in 6 months, much less 6 years and they want to make sure that their prenup terms don't change depending on where they live. Enter a choice of law clause. 

This means that no matter where they are, their prenup means the same thing. If they go to California, they aren't suddenly subject to community property laws. If they move to Florida, their agreement to have penalties for adultery still stands. Move to an overseas base, and the same laws apply as if they were here in Georgia. Piece of mind from a single sentence.
