When a Father Isn’t a Father

Fathers in Georgia have no rights to their children unless they are married to the mother at the time of birth.


My client Xander* has been there since the day his son was born- birthdays and first days of school. 

But when his son’s mom got sick, Xander wasn’t considered by the Division of Family and Child Services because Xavier hadn’t gotten legal rights through a process called Legitimation. Xander’s son ended up in foster care. 

Last week, Xander became his son’s legal father. Now Xander gets to make memories with his son everyday.
